The original complaint was dismissed by the District Court for failure to state a claim for which relief could be granted, and the O’Connells were ordered to pay costs and attorney fees. The O’Connells then appealed to the Supreme Court. The Court returned the matter to the District court and the O’Connells have filed an amended complaint.
